We need all of the support we can possibly get.Peremptory challenges are a critical component of our jury selection process, as they provide prosecution and defense counsel a limited number of strikes for jurors suspected of harboring bias. This process provides certain assurances to both sides of a fair and impartial jury. Following the passage of AB 3070 in 2020, peremptory challenges and the way in which they are exercised in criminal cases changed significantly. Among those changes was the presumption that a peremptory challenge based on a prospective juror’s views related to law enforcement was invalid. This essentially removed the ability for jurors to be struck on a peremptory basis if the challenge was determined to be connected with a juror’s anti-law enforcement views. These changes have allowed anti-law enforcement bias into our jury system, compromising the principle of a fair trial for those who serve to protect us. AB 3039 addresses this issue by removing the presumptive invalidity of peremptory challenges based on a prospective juror’s views related to law enforcement. This adjustment is crucial to maintaining the integrity of our legal system and ensuring that law enforcement officers can be judged by an impartial jury. The passage of AB 3039 will not only correct the imbalance caused by AB 3070 but also reinforce our commitment to a just and equitable legal process for all parties involved.AB3070 allowed the man who attempted to execute me on duty walk free.     This is almost criminal. Federal and state courts in California are overwhelmed with cases and lack resources. Despite major technological advances that our courts are now using, the wheels of justice move slower than ever, leading to poor outcomes and increased costs for litigants. Things were way better in the 90s when I first started practicing law. Meanwhile, alternative dispute resolution, a significant pressure valve for the court system, is under attack. Non-lawyers may not realize the severity of this problem, but it is real.
